This website cartier.com/en-in (along with its mobile application thereof, together the "Platforms") is operated by Richemont India Private Limited, a company incorporated under the Companies Act, 1956 having its registered offices at Regus Business Centre, Level-4, Rectangle-1 Commercial Complex, D-4, Saket Delhi – 110017, India.

These Terms of Use and our Privacy Policy (collectively the “Terms”) govern your use of the Platforms. In these Terms of Use, we use the term Cartier (and "we", "us" and "our") to refer to Richemont India Private Limited and its affiliates.

Please read these Terms of Use carefully before using the Platforms because they constitute a legal agreement between Richemont India Private Limited and you. By using the Platforms, you signify that you have understood the Terms, provide your assent and agreement to these Terms of Use and affirm that you are able and legally competent to do so.

These Terms constitute an electronic record within the meaning of the Information Technology Act, 2000 and the rules and regulations framed thereunder, as may be amended from time to time. This electronic record is generated by a computer system and does not require any physical or digital signatures.

We may make changes from time to time to these Terms of Use so please check back regularly to keep informed of updates. The latest version of these Terms of Use will always be available on the Platforms. Any new version of these Terms of Use shall take effect and will govern the use of the Platforms and your relationship with us immediately upon the date of posting, and will supersede all previous versions of the Terms of Use. By continuing to use the Platforms, you agree to be bound by such updated and amended Terms of Use.

Hosting Services for our website is provided by Richemont India Private Limited in India.

Mobile applications may be hosted by us or by other companies and you should refer to the relevant conditions of such other company.

Our information collection practices on the Platforms, such as the types of information we collect regarding visitors to the Platforms and the ways in which we may use that information, are governed by the terms of our Privacy Policy.

Cartier has created its various Platforms to provide information about its company and products for your personal use. Whilst considerable effort has been made to ensure that the visual representations of Cartier products displayed on the platforms are representative of the colour, design and style etc. of the original products, slight variations, distortions and/or differences may be apparent when compared to the original product. This may, for example, be due to technical issues such as your browser or computer settings. Accordingly, Cartier cannot be held liable for any apparent differences in the product images represented on the Platforms and the original products. We strongly advise you visit one of our boutiques or authorised retailers prior to making a purchase online or by phone. You may download one computer copy or print one copy of the material made available to you via the Platforms, or download the application on to your mobile device, for your own non-commercial, educational, private or domestic use only, provided that proprietary notices, in particular intellectual property notices such as copyright©, trademark™, are preserved intact and are not modified, deleted or changed. Unless otherwise stated, you should assume that everything that you see or read on the Platforms (such as images, photographs, including any person represented in the photographs, illustrations, icons, texts, video clips, music, written and other materials) ("Cartier Material") are protected by legislation such as copyright, designs and trademark legislation and under international treaty provisions and national laws worldwide.

You are not authorised to sell, reproduce, distribute, communicate, modify, display, publicly perform, report or otherwise prepare derivative or second hand works based on or use any Cartier Material in any way for any public or commercial purposes. Furthermore, Cartier Material may not be displayed or communicated on any other platform, in a networked computer environment or on any other digital platform for any purpose whatsoever. In the event of breach of any of these Terms of Use, your permission to use Cartier Material will automatically terminate and any copies made of Cartier Material must be immediately destroyed. Any unauthorised use of Cartier Material may infringe copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.

This section concerns communications sent to Cartier. It does not concern the communication of personal information to Cartier in relation to customer enquiries, the use of services or the purchase of products by phone or through the Platform. The latter is governed by the rules stipulated in the Privacy Policy.

Any unsolicited communication or material that you transmit to Cartier via the Platforms or through social media, by electronic mail or otherwise, including, but not limited to, any data, questions or answers, comments, suggestions, or the like will be treated as non-confidential and non-proprietary by Cartier. By sending communications to Cartier, you automatically grant Cartier a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, publish, edit, translate, distribute, perform, and display such communication(s) alone, or as a part of other works in any form, media, or technology whether now known of hereafter developed and to sublicense such rights to anyone. Anything that you transmit may be used by Cartier and its affiliated companies for any purpose, including but not limited to reproduction, disclosure, transmission, publication, broadcast and posting, or developing, manufacturing and marketing products using such information.

Furthermore, Cartier enjoys a worldwide reputation for both the design and manufacture of jewellery, high jewellery, high quality luxury watches, leather goods and other luxury goods. To this end, it possesses its own sources of creativity, in particular highly skilled teams of designers who conceive and perfect Cartier’s creations. As a result, Cartier cannot agree to or accept to be the receiver of unsolicited proposals of collaboration. Indeed, it is conceivable that Cartier may already be working on similar ideas and/or creations. Consequently, you are advised that Cartier is not interested in receiving ideas or other proposals relating to creations you may wish to submit.

This section applies to the Platforms and not to the products that may be sold by one of our local or regional markets.

Cartier tries to ensure that the information provided is accurate and complete. However, Cartier does not warrant or represent that Cartier Material is accurate, error-free, legal, decent or reliable or that use of Cartier Material will not infringe rights of third parties.

Cartier does not warrant that the functional and/or technical aspects of the Platforms or the Cartier Material will be error free or that defects will be corrected or that the Platforms, Cartier Material or the servers that make them available are free of viruses or other harmful components. If use of the Platforms or Cartier Material results in the need for servicing or replacing property, material, equipment, data or other element, Cartier is not responsible for those costs. Without limiting the foregoing, the Platforms and everything on the Platforms (including the materials, information and references to services and products herein, including without limitations, text, graphics and links), are provided to you "AS IS" AND "AS AVAILABLE" AND, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, REASONABLE CARE AND SKILL, NON-INFRINGEMENT, USE OF THE PLATFORMS WILL BE UNINTERRUPTED OR ERROR-FREE, FREEDOM FROM COOKIES, COMPUTER VIRUS AND WARRANTIES ARISING FROM COURSE OF TRADE OR COURSE OF PERFORMANCE OF SERVICES. Cartier and its suppliers make no warranties about the Cartier Material, software, text, downloads, graphics, and links, or about results to be obtained from using the Platforms. We do not make any warranties or representations regarding the use of the materials on the Platform in terms of their completeness, correctness, accuracy, adequacy, correctness, timeliness, reliability or otherwise. Any oral or written advice provided by Cartier or its authorized agents does not and will not create any warranty.

To the fullest extent permitted by applicable law, Richemont India Private Limited shall not be liable for any indirect, incidental, special or consequential damages of any kind arising out of or in connection with the use of information available from the Platforms or any liability relating to any loss of use, interruption of business, loss of goodwill, work stoppage, accuracy of results, lost profits or lost data, regardless of the form of action, whether in contract, tort (including negligence) or otherwise, even if Cartier has been advised of the possibility of such damages. Notwithstanding anything to the contrary, our maximum aggregate liability in respect of all services availed on and from the Platforms and the use of the Platforms shall not exceed INR 5,000.

Indemnification

You agree to indemnify and defend Richemont India Private Limited, its affiliates and their respective directors, officers, employees and agents from and against all losses, liabilities, actual or pending claims, actions, damages, expenses, costs of defense and reasonable attorneys’ fees arising as a result of your use of the Platforms or breach of these Terms. You also agree to indemnify us for any loss, damages, or costs, including reasonable attorneys' fees, resulting from your use of software robots, spiders, crawlers, or similar data gathering and extraction tools, or any other action you take that imposes an unreasonable burden or load on our infrastructure.

Use of materials on the Platforms

Cartier has created its various Platforms to provide information about its company and products for your personal use. Furthermore, Cartier Material may not be displayed or communicated on any other platform, in a networked computer environment or on any other digital platform for any purpose whatsoever. Your submissions and unsolicited communications

This section concerns communications sent to Cartier. It does not concern the communication of personal information to Cartier in relation to customer enquiries, the use of services or the purchase of products. The latter is governed by the rules stipulated in the Privacy Policy.

Any unsolicited communication or material that you transmit to Cartier via the Platforms or through social media, by electronic mail or otherwise, including, but not limited to, any data, questions or answers, comments, suggestions, or the like will be treated as non-confidential and non-proprietary by Cartier. Consequently, you are advised that Cartier is not interested in receiving ideas or other proposals relating to creations you may wish to submit.

You hereby agree and undertake not to use the Platforms to do any of the following acts:

  1. Post, contribute, display, transmit or share any material that:
    1. infringes any intellectual property rights including without limitation any copyrights and related rights, trademarks, trade dress, service marks, design rights, utility models, trade secrets, know-how, patent rights, goodwill, rights of publicity or other proprietary rights of any party, including Cartier;
    2. is unlawful, fraudulent, deceptive, harmful, threatening, abusive, harassing, tortuous, excessively violent, defamatory, vulgar, obscene, pornographic, paedophilic, libelous, invasive of another's privacy, hateful, disparaging, relating or encouraging money laundering or gambling, or menacing in nature, racially, ethnically or otherwise objectionable,;
    3. you do not have a right to sell or transmit under any law or under contractual or fiduciary relationships;
    4. poses or creates a privacy or security risk to any person;
    5. constitutes unsolicited or unauthorized advertising, promotional materials, commercial activities and/or sales, "junk mail," "spam," "chain letters," "pyramid schemes," "contests," "sweepstakes," or any other form of solicitation;
    6. Deceives or misleads about the origin of material submitted;
    7. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; or
    8. in the sole judgment of Cartier, is objectionable or which restricts or inhibits any other person from using or enjoying the Platforms, or which may expose Cartier or its users to any harm or liability of any type;
  2. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
  3. Harm or solicit personal information from, anyone under the age of 18 or a who is or is deemed to be a minor under applicable law/s;
  4. Harvest or collect email addresses or other contact information of other users from the Platforms by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications;
  5. Advertise or offer to sell or buy any goods or services other than those intended to be sold and purchased through the Platforms;
  6. Interfere with or disrupt the Platforms or servers or networks connected to the Platforms, or violate any requirements, procedures, policies or regulations of networks connected to the Platforms;
  7. "Crawls," "scrapes," or "spiders" any page, data, or portion of or relating to the Platform or Cartier Material (through use of manual or automated means);
  8. Copies or stores any significant portion of the Cartier Material;
  9. Decompiles, reverse engineers, or otherwise attempts to obtain the source code or underlying ideas or information of or relating to the Platforms;
  10. Violate any applicable local, state, national or international law, or any regulations having the force of law;
  11. Further or promote any criminal activity or enterprise or provide instructional information about illegal activities;
  12. Obtain or attempt to access or otherwise obtain any materials or information through any means not intentionally made available or provided for through the Service; or
  13. Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting any other nation.

In general, all trademarks, logos and service marks (collectively the "Trademarks") that appear on the Platforms are registered, unregistered or otherwise protected Cartier trademarks or are licensed for use by Cartier by third parties. Other trademarks are proprietary marks and are registered to their respective owners. Nothing contained on the Platforms should be construed as granting, by implication or otherwise, any licence or right to use any trademark without Cartier’s prior written permission or that of such third party who owns the trademark. Misuse of any trademark displayed on the Platforms, or any other content on the Platforms, except as provided herein, is strictly prohibited.

All content (including Cartier Materials) on the Platforms are either Copyright © Cartier or are licensed for use by Cartier. All rights are reserved. Please refer to the section above on Use of Materials on the Platforms.

The Platforms may contain links to other websites, platforms and services (including social media) operated by third parties not affiliated to Cartier (collectively the “Linked Sites”). Linked Sites are not under the control of Cartier and Cartier has not reviewed all of the content contained in the Linked Sites and is not responsible for the content or accuracy of any off-site pages or any other sites linked to any of the Platforms. The inclusion of any link to such Linked Sites does not imply endorsement by Cartier of those sites or association with the operators of the Linked Sites. If you choose to click through any link to off-site pages or third party sites then this is at your own risk. Cartier does not authorise linking to any of its Platforms from a third party platform without its express prior written authorisation.

You agree that Cartier may terminate or suspend your access to and use of the Platforms if Cartier reasonably believes that you have violated or acted inconsistently with the letter or spirit of these Terms of Use, or violated the rights of Cartier, its affiliated companies or any third party, with or without notice to you. You agree that Cartier may modify or discontinue providing any of the Platforms, with or without notice to you. You agree that Cartier will not be liable to you or any third party as a result of such modification or discontinuation. The provisions entitled "Limitation of liability" and "General provisions" will survive termination of these Terms of Use.

Takedown Policy

Zero Tolerance Policy: Cartier respects the intellectual property of others, and has a zero tolerance policy for intellectual property infringement. Infringement of intellectual property impacts our business and your experience of our Platforms. Cartier reserves the right to investigate and take appropriate action against anyone who, in Cartier’s sole discretion, violates these Terms of Use, including without limitation, removing the infringing content from the Platforms, suspending or terminating the account of such infringers and reporting them to law enforcement authorities.

Reporting Procedure: Cartier encourages users / customers to bring to our attention and report any suspected intellectual property infringement on the Platforms. Cartier will promptly process and investigate such reports and may take appropriate actions under the applicable intellectual property laws with respect to any alleged or actual infringement, including co-operation with law enforcement authorities, if required. If you suspect that any content on the Platforms is infringing any of your intellectual property rights, we encourage you to contact us immediately by sending an e-mail to vineetbansal@richemont.com and provide us with a detailed and reasonably accurate description of the infringing content along with any details that would help us identify the same, including a screenshot of the page displaying such content, if possible. If you are the owner of the intellectual property alleged to be infringed, please also provide us with your contact information along with documents to indicate (a) the copyrighted work / trademark / other article whose intellectual property may have been infringed, and (b) that you are the owner of the intellectual property. This is to enable Cartier to investigate and take appropriate action expeditiously.

Unless otherwise specified, the information and materials presented on the Platforms are presented solely for the purpose of promoting Cartier’s products and services and in certain cases to present products for sale via a variety of means. Cartier makes no representation that Cartier Material is appropriate or available for use in every country of the world. You are responsible for compliance with applicable local laws, keeping in mind that access to Cartier Material may not be legal by certain persons or in certain countries. Our products are available in many parts of the world. However, the Platforms may identify products that are not available worldwide.

If any provision, or part of a provision, of these Terms of Use is found to be illegal, invalid or unenforceable, that provision or part-provision shall be deemed not to form part of these Terms of Use, and the legality, validity or enforceability of the remainder of the provisions of these Terms of Use shall not be affected, unless otherwise required by operation of applicable law.

The Terms of Use constitute the entire agreement between you and us in relation to the use of the Platform, and replace and extinguish all prior agreements, draft agreements, arrangements, undertakings, or collateral contracts of any nature made by the parties, whether oral or written, in relation to such subject matter.

The waiver by Cartier of a breach of any provision of these Terms of Use will not operate to be interpreted as a waiver of any other or subsequent breach.

If you breach these Terms of Use and we take no immediate action, this does not mean that we will not be entitled to assert our rights and remedies at a later date.

These Terms of Use shall be governed by and construed in accordance with the laws of India, without reference to conflict of laws provisions and subject to the arbitration provisions hereinafter, the courts in New Delhi shall have exclusive jurisdiction for resolution of disputes arising from the use of the Platforms. Any dispute, controversy or claim arising out of or in relation to the Terms of Use, including the validity, invalidity, breach or termination thereof, shall be subject to arbitration in New Delhi in accordance with the Arbitration and Conciliation Act, 1996. The arbitration proceedings shall be conducted in English language by a sole arbitrator appointed by Richemont India Private Limited. Arbitration awards shall be reasoned awards and shall be final and binding on Richemont India Private Limited and the disputing user and shall be enforceable in any court of competent jurisdiction.
